EXEMPTION AND RELEASE OF LIABILITY
WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT
Please read the following agreement carefully BEFORE DECIDED TO PARTICIPATE . By signing this document, YOU EXPRESSLY AGREE THAT YOU HAVE KNOWLEDGELY, COMPLETELY, AND TOTALLY RELEASED the Owner/Company/Its agents and employees (hereinafter, «The Released») FROM ANY AND ALL CLAIMS, INCLUDING ACTIVE OR PASSIVE NEGLIGENCE, BUT EXCLUDING GROSS NEGLIGENCE AND/OR INTENTIONAL MISCONDUCT , ARISING FROM ANY ACT, Omission, OR CONDITION EXISTING PRIOR TO THE SIGNING OF THIS AGREEMENT, AND EXTENDING TO INCLUDE ANY ACT, Omission, OR CONDITION IN ANY WAY RELATED TO YOUR PARTICIPATION IN (including transit to and from) THESE WATER SPORTS ACTIVITIES, WHICH MAY OCCUR AT ANY TIME IN THE FOLLOWING TIMES OUT OF THE ACTIVITIES IN WHICH YOU ARE ABOUT TO PURCHASE/PARTICIPATE.
IN CONSIDERATION of Resort Management, SA, doing business as Los Buzos Resort («The Released Party») allowing me to participate in each and every recreational activity or event in which Los Buzos is involved in any way (the «Activities»), I, for myself and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby accept and make the following contractual representations pursuant to this Release and Agreement of Release of Liability, Assumption of Risk and Indemnity (the «Agreement»).
1. RECONOCIMIENTO DE RIESGOS. Reconocer que algunos, pero no todos, los riesgos de participar en la actividad de deportes acuáticos incluyen: (1) Cambiar el flujo de agua, las mareas, las corrientes, la acción de las olas y las estelas de los barcos; (2) Colisiones con cualquiera de los siguientes: otros participantes, la embarcación, otras embarcaciones y objetos naturales o hechos por el hombre: (3) Las acciones u omisiones negligentes de otros participantes; (4) Sus propias acciones u omisiones, su nivel de competencia en cuanto a la actividad y sus propias condiciones físicas y mentales; (5) cizalladura del viento, inclemencias del tiempo, relámpagos, variaciones y extremos del tiempo y la temperatura del viento; (6) Mi sentido del equilibrio, coordinación física, capacidad para operar equipos, nadar y/o seguir instrucciones; (7) Colisión, zozobra, hundimiento u otro peligro que resulte en humedad, lesiones, exposición a los elementos, hipotermia y/o ahogamiento; (8) La presencia en insectos y formas de vida marina; (9) falla del equipo o error del operador; (10) lesiones o enfermedades relacionadas con el calor o el sol, incluidas las quemaduras solares, la insolación o la deshidratación; (11) Fatiga, escalofríos y/o mareos que pueden disminuir mi/o nuestro tiempo de reacción y aumentar el riesgo de accidente.
2. ASUNCIÓN EXPRESA DE RIESGO Y RESPONSABILIDAD. Al poner sus iniciales en esta sección y ejecutar esta RENUNCIA a continuación, acepta que ha revisado la lista anterior no exclusiva de ejemplos de riesgos inherentes involucrados en su participación en estas actividades, y con pleno conocimiento y comprensión, acepta voluntariamente comprometerse y participar. en estas actividades y ASUMAR VOLUNTARIA Y EXPRESAMENTE EL RIESGO DE DAÑOS CORPORALES GRAVES, LESIONES PERSONALES, MUERTE O DAÑOS resultantes de todos y cada uno de los riesgos inherentes al participar y participar en (incluido el tránsito hacia y desde) estas actividades de deportes acuáticos. Al asumir expresamente CUALQUIERA Y TODOS LOS RIESGOS INHERENTES relacionados con estas actividades de deportes acuáticos, usted renuncia voluntariamente a la capacidad de buscar o cobrar daños del Exonerado debido a cualquier lesión personal, reclamo o incidente que ocurra o esté relacionado de alguna manera con o que surja de la riesgos inherentes de su participación en estas actividades de deportes acuáticos. ESTOY DE ACUERDO EN UTILIZAR un dispositivo de flotación personal aprobado mientras participo en la actividad o viajo en cualquier embarcación.
3. RELEASE . I hereby release Resort Management, SA, its principals, directors, officers, agents, employees and volunteers, its insurers, and each and every one of the landowners, municipal and/or government agencies on whose property an activity is conducted («owner») and their insurers, if any, (collectively «Releases») FROM ANY LIABILITY OF ANY NATURE FOR ANY INJURY OR DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN AND OTHER PERSONS as a result of my/our participation in the activity, EVEN IF CAUSED BY THE NEGLIGENCE OF ANY OF THE ABOVE-NAMED RELEASED PARTIES, OR ANY OTHER PERSON (INCLUDING ME).
4. PUBLICATION OF PHOTOS . I hereby authorize Resort Management, SA, to publish photographs or videos taken of me, or of persons under my legal guardianship, for use in Los Buzos Resort’s print and online publications, as well as for any external third-party interests. In consideration for my voluntary participation in publications produced by Los Buzos Resort, or for any other third-party interests, I agree that I will not receive any financial compensation. I further agree that participation in any print or online publication produced by Resort Management, SA, or for external third-party interests, does not confer ownership or any special rights of any kind.
I HAVE READ THIS ASSUMPTION AND ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING VALID LEGAL RIGHTS, INCLUDING ALL RIGHTS I MAY HAVE AGAINST THE OWNER, THE OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS, OR ASSIGNEES.
*EACH ADULT PARTICIPANT MUST INDIVIDUALLY SIGN A WAIVER. Parental Consent (Required if participant is under 18 years of age) As the parent or legal guardian of the minor identified below, I accept and agree to all the terms and conditions of this Agreement on behalf of the minor in connection with the minor’s participation in the Activities. If, notwithstanding this Agreement, I, or anyone on behalf of the minor, brings a claim of Liability against any of the Released Parties, I will indemnify, defend, and hold harmless each of the Released Parties from any liability that may be incurred as a result of such claim.
