EXEMPTION AND RELEASE OF LIABILITY<\/h1>

WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT<\/span><\/span><\/strong><\/p>

Please read the following agreement carefully <\/span><\/span>BEFORE DECIDED TO PARTICIPATE<\/span><\/span><\/strong> . By signing this document, <\/span><\/span>YOU EXPRESSLY AGREE THAT YOU HAVE KNOWLEDGELY, COMPLETELY, AND TOTALLY RELEASED<\/span><\/span><\/strong> \u00a0the Owner\/Company\/Its agents and employees (hereinafter, \u00abThe Released\u00bb)\u00a0 <\/span><\/span>FROM ANY AND ALL CLAIMS, INCLUDING ACTIVE OR PASSIVE NEGLIGENCE, BUT EXCLUDING GROSS NEGLIGENCE AND\/OR INTENTIONAL MISCONDUCT<\/span><\/span><\/strong> , ARISING FROM ANY ACT, Omission, OR CONDITION EXISTING PRIOR TO THE SIGNING OF THIS AGREEMENT, AND EXTENDING TO INCLUDE ANY ACT, Omission, OR CONDITION IN ANY WAY RELATED TO YOUR PARTICIPATION IN (including transit to and from) THESE WATER SPORTS ACTIVITIES, WHICH MAY OCCUR AT ANY TIME IN THE FOLLOWING TIMES OUT OF THE ACTIVITIES IN WHICH YOU ARE ABOUT TO PURCHASE\/PARTICIPATE.<\/span><\/span><\/p>

IN CONSIDERATION<\/span><\/span><\/strong> \u00a0of Resort Management, SA, doing business as Los Buzos Resort (\u00abThe Released Party\u00bb) allowing me to participate in each and every recreational activity or event in which Los Buzos is involved in any way (the \u00abActivities\u00bb), I, for myself and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby accept and make the following contractual representations pursuant to this Release and Agreement of Release of Liability, Assumption of Risk and Indemnity (the \u00abAgreement\u00bb).<\/span><\/span><\/p>

1. RECONOCIMIENTO DE RIESGOS<\/strong>. Reconocer que algunos, pero no todos, los riesgos de participar en la actividad de deportes acu\u00e1ticos incluyen:\u00a0(1)<\/strong>\u00a0Cambiar el flujo de agua, las mareas, las corrientes, la acci\u00f3n de las olas y las estelas de los barcos; (2)<\/strong> Colisiones con cualquiera de los siguientes: otros participantes, la embarcaci\u00f3n, otras embarcaciones y objetos naturales o hechos por el hombre: (3)<\/strong> Las acciones u omisiones negligentes de otros participantes; (4)<\/strong>\u00a0Sus propias acciones u omisiones, su nivel de competencia en cuanto a la actividad y sus propias condiciones f\u00edsicas y mentales; (5)<\/strong> cizalladura del viento, inclemencias del tiempo, rel\u00e1mpagos, variaciones y extremos del tiempo y la temperatura del viento; (6)<\/strong>\u00a0Mi sentido del equilibrio, coordinaci\u00f3n f\u00edsica, capacidad para operar equipos, nadar y\/o seguir instrucciones; (7)<\/strong>\u00a0Colisi\u00f3n, zozobra, hundimiento u otro peligro que resulte en humedad, lesiones, exposici\u00f3n a los elementos, hipotermia y\/o ahogamiento; (8)<\/strong>\u00a0La presencia en insectos y formas de vida marina; (9)<\/strong> falla del equipo o error del operador; (10)<\/strong> lesiones o enfermedades relacionadas con el calor o el sol, incluidas las quemaduras solares, la insolaci\u00f3n o la deshidrataci\u00f3n; (11)\u00a0<\/strong>Fatiga, escalofr\u00edos y\/o mareos que pueden disminuir mi\/o nuestro tiempo de reacci\u00f3n y aumentar el riesgo de accidente.<\/p>

2. ASUNCI\u00d3N EXPRESA DE RIESGO Y RESPONSABILIDAD<\/strong>. Al poner sus iniciales en esta secci\u00f3n y ejecutar esta RENUNCIA<\/strong> a continuaci\u00f3n, acepta que ha revisado la lista anterior no exclusiva de ejemplos de riesgos inherentes involucrados en su participaci\u00f3n en estas actividades, y con pleno conocimiento y comprensi\u00f3n, acepta voluntariamente comprometerse y participar. en estas actividades y ASUMAR VOLUNTARIA Y EXPRESAMENTE EL RIESGO DE DA\u00d1OS CORPORALES GRAVES, LESIONES PERSONALES, MUERTE O DA\u00d1OS<\/strong> resultantes de todos y cada uno de los riesgos inherentes al participar y participar en (incluido el tr\u00e1nsito hacia y desde) estas actividades de deportes acu\u00e1ticos. 3. RELEASE<\/span><\/span><\/strong> . I hereby release Resort Management, SA, its principals, directors, officers, agents, employees and volunteers, its insurers, and each and every one of the landowners, municipal and\/or government agencies on whose property an activity is conducted (\u00abowner\u00bb) and their insurers, if any, (collectively \u00abReleases\u00bb)\u00a0 <\/span><\/span>FROM ANY LIABILITY OF ANY NATURE FOR ANY INJURY OR DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN AND OTHER PERSONS<\/span><\/span><\/strong> as a result of my\/our participation in the activity, <\/span><\/span>EVEN IF CAUSED BY THE NEGLIGENCE OF ANY OF THE ABOVE-NAMED RELEASED PARTIES, OR ANY OTHER PERSON (INCLUDING ME).<\/span><\/span><\/strong><\/p>

4. PUBLICATION OF PHOTOS<\/span><\/span><\/strong> . I hereby authorize Resort Management, SA, to publish photographs or videos taken of me, or of persons under my legal guardianship, for use in Los Buzos Resort’s print and online publications, as well as for any external third-party interests. In consideration for my voluntary participation in publications produced by Los Buzos Resort, or for any other third-party interests, I agree that I will not receive any financial compensation. I further agree that participation in any print or online publication produced by Resort Management, SA, or for external third-party interests, does not confer ownership or any special rights of any kind.<\/span><\/span><\/p>

I HAVE READ THIS ASSUMPTION AND ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING VALID LEGAL RIGHTS, INCLUDING ALL RIGHTS I MAY HAVE AGAINST THE OWNER, THE OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS, OR ASSIGNEES.<\/span><\/span><\/strong><\/p>

*EACH ADULT PARTICIPANT MUST INDIVIDUALLY SIGN A WAIVER.<\/span><\/span><\/strong> Parental Consent (Required if participant is under 18 years of age) As the parent or legal guardian of the minor identified below, I accept and agree to all the terms and conditions of this Agreement on behalf of the minor in connection with the minor’s participation in the Activities.
